An Ordinance authorizing Richland County, South Carolina (the "Issuer") to issue, from time to time or at one time, in one or more issues or series, its revenue bonds in an aggregate principal amount not to exceed $20,000,000 (the "Bonds"), the proceeds of which will be used to finance the acquisition, construction and renovation of certain property to be used in connection with the Eastover, South Carolina Mill (the "Mill") of International Paper Company (the "Company"), located at 4001 McCords Ferry Drive in Eastover, South Carolina, consisting of capital improvements, including, but not limited to, any recovery zone property, pulp mill and power facilities, paper production facilities and related facilities, at the Mill (the "Project"), pursuant to Section 4-29-10 et seq. of the 1976 Code of Laws of South Carolina, as amended; authorizing the execution and delivery of a contract of purchase providing for the issuance, sale and purchase of such Bonds; and authorizing the issuance of the Bonds and the execution of necessary documents and the taking of any other action necessary to be taken by the Issuer to cause the issuance and sale of such Bonds.

- The provider's usual and customary charge to the public for the prescription as written for the brand actually dispensed.
The SCDHHS estimates this action will increase total annual expenditures by approximately $8,500,000.

The South Carolina Department of Health and Human Services (SCDHHS), pursuant to the requirements of Section 1902(a)(13)(A) of the Social Security Act, gives notice of the following proposed actions regarding its methods and standards for paying providers under the State Plan under Title XIX of the Social Security Act Medical Assistance Program (Medicaid).
Effective on or after October 1, 2010, the SCDHHS proposes to amend the South Carolina (SC) Title XIX state plan as follows:
(1) The agency proposes to calculate the FFY 2010-2011 DSH payments in accordance with the December 19, 2008 Final Rule and any future clarification guidance/policy changes that may be provided by the Centers for Medicare and Medicaid Services (CMS) as it relates to the final rule.
(2) The agency proposes to update the base year used to calculate the FFY 2010-2011 DSH payments.
(3) The agency proposes to update the inflation rate used to trend the DSH base year cost to the DSH payment period.
(4) The agency proposes to create a separate DSH payment pool for state owned governmental long term care psych hospitals in the event that relief is not granted to the December 19, 2008 Final Rule regulations via future clarification guidance/policy changes from CMS.
(5) The agency proposes to update its DSH payment methodology for the FFY 2010-2011 Medicaid state plan rate year to allow for the redistribution of the FFY 2010-2011 DSH allotment in accordance with the results of the FFY 2010-2011 DSH audit.
(6) The agency proposes to update the SC Medicaid inpatient hospital specific per discharge rates for SC general and out of state border hospitals with SC Medicaid inpatient utilization of at least 200 inpatient claims (per the hospital's 2006 base year cost report) using revised calibration adjustments based upon newly established hospital specific cost targets for the period beginning October 1, 2010. However, there will be no update to the statewide per diem rates and the statewide average per discharge rate. Additionally, hospital specific per diem multipliers will also be updated based upon newly established cost targets for the period beginning October 1, 2010. Retrospective cost settlements will continue
to be made at 100% of allowable Medicaid reimbursable costs for qualifying hospitals.
(7) The agency proposes to reimburse outpatient hospital clinical lab services using 100% of the 2010 Medicare Clinical Lab Fee Schedule rates for the state of South Carolina effective October 1, 2010 in accordance with Title XIX of the Social Security Act, Section 1903(i)(7).
(8) The agency proposes that while there will be no update to the October 1, 2007 SC Medicaid outpatient fee schedule rates for all contracting/enrolled hospitals, the hospital specific outpatient multipliers for qualifying hospitals will be updated effective October 1, 2010 based upon newly established cost targets for the period beginning October 1, 2010. Retrospective cost settlements will continue to be made at 100% of allowable Medicaid reimbursable costs for qualifying hospitals. However, effective October 1, 2010, outpatient hospital clinical lab services will no longer be retrospectively cost settled.
(9) The agency proposes to update the swing bed and administrative day rates to reflect the current average adjusted nursing facility rates.
(10) The agency proposes to allow non-state owned governmental long term care psych hospitals to receive annual retrospective cost settlements beginning October 1, 2010.
The SCDHHS proposes to implement actions (1) through (5) in order to calculate the FFY 2010/2011 DSH payments in accordance with the December 19, 2008 Final Rule requirements and any future CMS clarification guidance/policy changes. The SCDHHS estimates that these actions should not have a significant impact on expenditures and the SCDHHS will ensure that DSH payments for FFY 2010-2011 will not exceed the DSH allotment.
The SCDHHS proposes to implement actions number (6) and (8) in order to continue its annual effort of developing Medicaid fee for service rates/payments that closely approximate allowable SC Medicaid inpatient and outpatient costs based upon the most recent cost report and paid claims data available. Since the SCDHHS will continue to retrospectively cost settle SC general hospitals and qualifying hospitals meeting the burn intensive care unit criteria for the SC Medicaid inpatient and outpatient hospital services that they provide on an annual basis, there is no cost increase associated with this rate update except for the increase in
crossover payments and the increase related to the annual retrospective cost settlement payments.
The SCDHHS proposes to implement action number (7) in order to become compliant with Title XIX of the Social Security Act, Section 1903(i)(7).
The SCDHHS proposes to implement action number (9) in order to update the swing bed and administrative day rates to reflect the rebasing of the nursing facility rates that will be effective October 1, 2010. The SCDHHS will update the swing bed and administrative day rates to reflect changes to the adjusted average nursing home rate and the historical Alternative Reimbursement Method (ARM) rate used to project the pharmacy cost component of this rate. The swing bed rate is equal to the adjusted average nursing home rate and the administrative day rate is equal to the swing bed rate plus the ARM rate. The proposed swing bed per diem rate is estimated to be $154.67 (.72% increase). The estimated annual increase in swing bed payments is $7,000. The proposed administrative day per diem rate is estimated to be $163.83 (.79% increase). The intensive services administrative day per diem rate will remain at its December 1, 2008 payment level ($364.00). The estimated annual increase in administrative day payments is $3,000.
The SCDHHS proposes to implement action number (10) effective October 1, 2010 in order to ensure that the Medicaid allowable costs of providing services to eligible children in non-state owned governmental long term care psych hospitals are adequately reimbursed. The estimated annual increase in non-state owned governmental long term care psych hospital expenditures is estimated to be $300,000.
